要科学阐释土地经营权的生成进路及其体系定位,一方面要参考各国物权法上的一般原理,另一方面则要立足我国集体土地体制改革的实践经验和现阶段“三农”发展的实际需要。从“承包制”改革到“三权分置”改革,我国集体土地体制改革是一条在集体土地使用权与所有权之间既逐步分离又相互协调的改革进路。从集体土地物权体系构建来看,土地经营权须根据物权法上的“设定”原理,在集体土地所有权基础上通过“层层设定”或“层层解锁”而渐次生成。

英文摘要:

To scientifically explain the generation approach and system positioning of land management right,on the one hand,we should refer to the general principles of property law in various countries,on the other hand,we should be based on the practical experience of China’s collective land system reform and the actual needs of the development of “agriculture,rural areas and farmers” at this stage.From the reform of “contract system” to the reform of “separation of three rights”,China’s collective land system reform is a reform approach of gradual separation and mutual coordination between collective land use right and ownership.From the perspective of the construction of the collective land property right system,the land management right must be gradually generated through “layer by layer setting” or “layer by layer unlocking” on the basis of the collective land ownership according to the “setting” principle in the property law.
