中文摘要:

宅基地三权分置改革背景下,推进农村宅基地使用权流转是大势所趋。在城乡融合发展中,宅基地使用权流转的必要限制与合理扩张是宅基地使用权流转制度发展的关键,土地增值收益公平补偿和合理共享是土地发展权分析视角的核心要义。宅基地使用权流转制度的构建需体现以土地资源可持续发展为核心的生态功能、以土地利益分配正义为核心的社会功能以及以土地财产属性彰显为核心的经济功能内涵。同时,应妥善应对土地资源利用中存在着的生态风险和社会风险。在推进农村宅基地盘活利用中,须在把握差异性的基础上适度突破限制,构建合理的宅基地增值收益分配机制以达成分配正义,完善宅基地退出补偿机制以提高农民满意度,更应注重政府干预的合理边界以减轻政策风险,从而保障农民合法的土地权益。

英文摘要:

In the background of rural land contract reform,it is a general trend to promote the circulation of right to the use of curtilage.How to balance expansion and restriction of the circulation of right to the use of curtilage has become a key to constructing the circulation system of right to the use of curtilage.The key point of land development rights is fair compensation and reasonable sharing of land value added income. In the realization of land development right under the analytical dimension,the construction of right to the use of curtilage system should reflect three connotations.The first one is ecological functions,which is based on sustainable development of land resources.The second one is social functions,which mainly talk about the justice of land interests distribution.The third one is economic functions,which focus on the property of land estate.At the same time, we should properly deal with the ecological and social risks in the utilization of land resources.In promoting the revitalization and utilization of rural homesteads,we need to break through the limitation properly on the basis of grasping the difference,and also should focus on farmers and protect their interests.
