宅基地“三权分置”是新时代深化宅基地制度改革的关键,也是实现乡村振兴的重要抓手。在探究宅基地“两权分离”架构下的权能困境与乡村衰败互动关联的基础上,从理论上分析了宅基地“三权分置”的生成逻辑,进而指出“三权分置”下的“三重复合功能”定位能有效化解“两权分离”架构下权能困境,助推乡村振兴战略。在此基础上,系统总结了2015年以来试点地区宅基地“三权分置”实践探索中的权能实现,其经验表明:强化宅基地所有权的管理功能是提升乡村治理水平的内在要求;完善宅基地资格权的保障功能是保障农民生态宜居的重要制度保障;放活宅基地使用权的财产功能是实现农民生活富裕的有效途径。宅基地“三权分置”的深化路径在于“还权赋能”于三权的“增量权能”主体,从而使宅基地的“三重复合功能”得以有效发挥,最终实现乡村振兴。

英文摘要:

The “Three rights separation” in homesteads is the key to deepening the reform of homesteads system in the new era,and it is also an important starting point for the revitalization of rural areas.Based on the exploration of the interaction between the dilemma of power and the decline of rural areas under the structure of “two rights separation” in homesteads,this article theoretically analyzes the generation logic of “three rights separation” in homesteads,and then points out the “three rights separation” including “triple compound function” positioning can effectively resolve the property rights dilemma under the “two rights separation” structure,and promote the rural revitalization strategy.On this basis,the article systematically summarizes the realization of the power in the practical exploration of the “three rights separation” in homesteads in the pilot areas since 2015.Its experience shows that:strengthening the management function of homesteads ownership is an inherent requirement for improving the level of rural governance;perfecting the guarantee function of the homesteads eligibility right is an important institutional guarantee for ensuring farmers’ ecological livability;the property function of releasing the homesteads use right is an effective way for farmers to achieve a better life.Finally,the article proposes that the deepening path of “three rights separation” in homesteads lies in the “incremental power” subject of “returning powers and empowerment” to the three rights,so that the “triple compound function” of homesteads can be effectively exerted and finally the villages be revitalized.
